Residential Property Questions Answered

Yes. Non-UAE nationals can purchase property on a freehold basis in designated freehold zones. These include major residential areas such as Downtown Dubai, Dubai Marina, Palm Jumeirah, Jumeirah Village Circle, Arabian Ranches, and many others. Outside freehold zones, foreigners can purchase leasehold rights for a fixed term, typically 99 years. The Dubai Land Department (DLD) maintains the official register of all ownership.

In addition to the purchase price, buyers typically pay a DLD registration fee of 4% of the property value, a trustee registration fee, and agent commission (usually 2% of the purchase price). For mortgaged purchases, a bank mortgage registration fee of 0.25% of the loan amount also applies. There is no stamp duty, inheritance tax, or capital gains tax in the UAE on residential property.

A No Objection Certificate (NOC) is issued by the property developer confirming that there are no outstanding service charges or dues on a property before the DLD will register a sale. In a secondary market transaction, the seller must obtain the NOC from the developer before ownership can legally transfer to the buyer. This step typically takes a few days and involves a fee paid to the developer.

The rental market in Dubai is governed by the Real Estate Regulatory Agency (RERA). Tenants pay rent annually or in multiple cheques upfront — it is common to pay rent for a full year in one or two post-dated cheques. Rental increases are regulated by the RERA index, limiting how much a landlord can raise rent on an existing tenant. Security deposits are typically five percent of annual rent for unfurnished properties.

Many buyers purchase Dubai property remotely without travelling to the UAE. The process involves selecting a property, signing a Memorandum of Understanding (MOU), paying a deposit, and completing the transfer at the DLD — all of which can be handled via a power of attorney if you are not present. We coordinate with trusted legal representatives to ensure the transaction is secure and compliant for international buyers.
